PERRY, J. In April of 1989, Aaron B. Fodge, Sr., was found guilty by a jury of lewd and lascivious conduct with a minor under the age
of sixteen. I.C. § 18-1508. The district court sentenced Fodge to life in prison with a minimum period of thirty
years' confinement. Fodge initially appealed his conviction to the Idaho Supreme Court. The conviction was affirmed in January
of 1992. State v. Fodge, 121 Idaho 192, 824 P.2d 123 (1992).
